According to prosecutor Mike Mwalila, the incident took place around 03:07 AM when a club patron, Chikoti Mulendwe, stepped outside to take a phone call and heard gunshots. Witnesses reported that DJ Kandeke, visibly intoxicated, fired shots and pointed the firearm at Mulendwe, causing panic. Police later recovered cartridges from the scene as evidence.
Appearing in Ndola Magistrate Court, Kandeke admitted to his actions, claiming he had been provoked by an unidentified person during the event. He expressed remorse, stating:

Magistrate Brian Simachela ordered DJ Kandeke to pay a K300 fine within 24 hours, failing which he would serve six months of imprisonment with hard labor. Additionally, his pistol and ammunition have been confiscated for 60 days, after which he may apply for their return, subject to judicial approval.
The court also questioned why Kandeke was charged with a lesser offense, despite allegations that he pointed a gun at someone, which could have warranted a more serious charge like threatening violence.
